Using drums hits from other artists, cool or stealing?

I sometime use drum hits from other artists songs if it's a clean sample at a high bit rate that is not mp3. I don't sell my music nor do I do anything with it But if I were..... should I worry about it? I usually modify them to where you really can't tell. But you can't always be so sure.

The reasoning behind is because I don't make much money, and drums machines I can't afford right now.

Anyways, please help with some insight on this.

You can get free drum machine samples. Here's some (I wanted to link you to the Boi 1da sample pack too, but his website is down for some reason)

And it's pretty unlikely that you'll get in trouble for sampling drum hits from people, especially if you modify them. The other people on this form that will be able to tell you more, I really don't know a lot about this kind of stuff.

From a creative standpoint even this is fine if you do somethign sufficiently creative with it IE don't just lift a whole section of song, loop it and rap badly over it.

From a legal standpoint, it's asking for all hells of trouble if you don't clear the sample with whomever owns the rights, probably either the label/publisher or the artist themself.

If you want to have drum kits, the internet is full of kits for free, you only have to look for them. And it's better to look for "acoustic drum kit samples" or something similar, not things like "DJ Premer Drum Kit" or "9th Wonder drums pack". Also, you can search for some breaks, slice them as you want them to be and have your own drums.

Yeah, but lable owners/artists/publishers/whoever are not wasting their time on looking into some underground nu-beats releases, trying to crush each and every 16 years old home producer over illegal sample usage. If you are going REALLY big you may want to contact the owners of the rights, but still it's possible to rework samples in a way that people would not notice from where do they origin.

I'd also add that it's allright unless you are sampling other artists that make music of your genre or a genre that's really close. DropxLife sampled Thievery Corporation on his "Pawncho" album and it really seemed not ok to me. The other thing is that people who sample often put some effects on their samples, so if you sample their tracks, you're not working on clear samples. But that's only my point of view

If you're talking about popular electronic artists, you might as well just download some free drum machine samples or buy a Vengeance sample pack, because that's what 80% of them use. If it's something that you can do something creative with, and/or it's a unique sound that you "just gotta have", then just go ahead and sample it. Legally, as long as you aren't making money from it, they'll most likely leave you alone, and if you release it commercially on a label, a good label will make sure to get your samples cleared before they release the track.

I recommend the 200 Drum Machines pack linked in the first reply. Most of the samples are nice and clean, and you can layer, compress etc to beef up dem sounds, should you be so inclined They haven't been pushed to the limits of processing, so they are much easier to work with than e.g. Vengeance Essential Clubsounds (especially the kicks).

If you sample a single drum hit of a song I don't think any artist, even if it was their own kit, would flat out say "HEY! YOU STOLE MY HI TOM!" If anything someone might notice it's similar but people do it all the time. Even talking with Ethan Kath from Crystal Castles (who does all the production) he told me that he loves sampling kicks, snares, etc. because if it's off a good quality .wav then it's already mastered too!

yeah I have the 200 drum machines pack, I have had it for years. It's a good little pack.

Just looking for some stuff with some "umph".

I guess I should start making my own kicks. I bought the Aturia Moog Voyager plug a few months back. Guess I should start bearking into the sound design aspect of the plug. Now if only it ran in linux.

I've taken one shot kicks out of songs before. There's a song on the latest Gojira record that has a nice lonely kick and snare right before the song starts and I use the kick in a few songs.

In Canada, as far as I know, the recent copyright modernization act expands fair use or whatever it's called to include this kind of stuff. If it's for your own enjoyment and you aren't making money off it, you're pretty much good to go. I think that part was informally called the 'Youtube provision' or something like that.

Regardless, no one is going to come after you. Try to be creative, don't use vengeance samples and "it's already mastered" is so, so wrong.

Think of it this way, if you're doing that sort of thing, and people like it, you end up making a couple bucks, then the record company you've been ripping off starts to notice, they notice you're making money, they like money, they decide to give you a contract to do that sort of thing with all the samples cleared. Is that so hard to imagine?


Just because huge corporations don't like people stealing and profiting off their products (and who can blame them in that respect, honestly?) doesn't mean they're all evil heartless monsters by default.
